These are the rules for using Delvry. They're meant to be read in plain English. If something here is unclear or unfair, email hello@delvry.ai.
#The agreement
By creating a Delvry account or calling our API with a key, you agree to these terms. If you're using Delvry on behalf of a company, you're saying you have authority to bind that company. If we update the terms in a way that materially changes your obligations, we'll email you at the address on file before the change takes effect.
#Acceptable use
Delvry exists for AI agents to ask humans structured questions and store the answers. Don't use it to do harm. Specifically:
- Don't send unsolicited bulk messages. Recipients should expect your invite — usually because they work with you, are your customer, or asked to be contacted.
- Don't use Delvry to phish, harass, defraud, or impersonate anyone.
- Don't try to break the service — no probing for vulnerabilities outside our disclosure program (see /security), no credential stuffing, no resource-exhaustion attacks.
- Don't use Delvry to collect data the law says you can't collect (children under 13 without verifiable parental consent, regulated health/financial data without an underlying business agreement, etc.).
- Don't resell raw API access as your own product. Building on top of Delvry is encouraged; reselling Delvry-as-a-service is not.
If you violate any of this, we may suspend or terminate your account, with or without notice depending on severity.
#Your content
You own the surveys you author and the responses your recipients submit. We get a narrow license to host, process, and deliver that content as needed to run the service. We never use your content to train models, and we never federate it across accounts.
#No warranty
Delvry is provided as is. We work hard to keep the service available, fast, and correct, but we don't promise it. There's no warranty of merchantability, fitness for a particular purpose, or non-infringement. If Delvry goes down or returns the wrong answer, your remedy is to stop using it.
#Limitation of liability
To the maximum extent permitted by law, Delvry's total liability to you for any claim arising out of or relating to this service is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) one hundred US dollars. We are not liable for indirect, incidental, consequential, or punitive damages — lost profits, lost data, business interruption — even if we knew or should have known they were possible.
#Termination
You can close your account at any time by emailing hello@delvry.ai or, when web tooling ships, from the dashboard. We can suspend or terminate your account if you breach these terms, if we're required to by law, or if running your account becomes impractical (extreme abuse, unpaid invoices, etc.). On termination we'll give you a reasonable window to export your data unless legal process forbids it.
#Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute that can't be resolved by good-faith conversation goes to the state or federal courts located in Delaware, and you consent to personal jurisdiction there. If you're a consumer in a jurisdiction whose local law gives you stronger protections than Delaware, those protections still apply.
#Misc
If a court finds part of these terms unenforceable, the rest still applies. Our failure to enforce any provision isn't a waiver of it. You can't assign these terms without our written consent; we can assign them as part of a merger, acquisition, or sale of assets.
